Terms of Service

1. Who we are

Ponko (playponko.com) is a service for hosting and playing live quiz games, operated by the Ponko team. These terms are the agreement between you and us. By using Ponko you accept them; if you don't, please don't use the service.

2. Who can use Ponko

Ponko isn't directed at children under 16. If you're under 16, please use it only with the involvement of a parent, teacher, or guardian. If you're using Ponko on behalf of an organisation, you confirm you're allowed to accept these terms for it.

3. Your account

You don't need an account to join a game, and you don't need one to host a one-off game. Saving quizzes, sharing them publicly, and generating questions with AI do require one. Keep your credentials to yourself — anything done through your account is treated as done by you. Tell us at contact@playponko.com if you think someone else has access to it.

4. Your content

The quizzes, questions, and images you create stay yours. To run the service we need permission to store them, show them to the players in your games, and — if you choose to make a quiz public — display it in the gallery and let other hosts copy it into their own account. That permission is limited to operating Ponko, lasts as long as you keep the content on the service, and ends when you delete it. Making a quiz public is a decision you make per quiz, and you can make it private again at any time; copies other hosts already made remain theirs.

You're responsible for what you upload: that you have the right to use it, and that it doesn't break the law or infringe anyone else's rights.

5. Acceptable use

Don't use Ponko to:

  • Upload illegal, hateful, or infringing content.
  • Harass, impersonate, or endanger other people.
  • Bypass security, scrape data at scale, or otherwise disrupt the service for others.
  • Use the AI question generator for purposes unrelated to making a quiz, or to produce harmful content.
  • Resell Ponko or present it as your own service.

We may remove content or suspend an account that breaks these rules. Where it's reasonable to do so we'll tell you why, and you can reply at contact@playponko.com.

6. AI-generated questions

Ponko can draft quiz questions for you using AI. AI gets things wrong, including confidently — read what it produces before you put it in front of a room. The generated questions are a starting point you're expected to edit, and you remain responsible for what you host. We don't warrant that generated content is accurate, original, or suitable for any particular audience.

7. What Ponko provides

Hosting and playing are free. A single game holds up to 190 players. There are limits on how many quizzes you can save and how often you can use AI generation, so that one account can't exhaust shared capacity; the current limits are shown in the app and answered in the FAQ.

Ponko is a live service that depends on third-party infrastructure, so we can't promise it will always be available or uninterrupted. We may change, add, or remove features, and if we ever discontinue the service we'll give reasonable notice so you can export your quizzes first.

8. Advertising

Ads help cover the cost of keeping Ponko free. Ads are served by Google, which asks for your consent in its own dialog before anything is stored for advertising; you can change or withdraw that at any time through "Cookie settings" in the footer. We don't sell your data, and we don't give advertisers your account, quiz, or game content. The Privacy Policy explains what is collected and by whom.

9. Ending your account

You can delete your account whenever you like, from Account settings — it's immediate, and the Privacy Policy explains exactly what is erased and what is anonymised. We may suspend or close an account that seriously or repeatedly breaks these terms. Sections 4, 10, and 11 continue to apply after an account ends.

10. Warranties and liability

Ponko is provided as it is, without warranties of any kind. To the fullest extent the law allows, we're not liable for indirect or consequential loss, lost profits, lost data, or losses caused by circumstances outside our reasonable control.

Nothing here limits liability that can't legally be limited — including for death or personal injury caused by negligence, or for fraud. If you're a consumer, you keep all the rights your local consumer law gives you, and nothing in these terms takes them away.

11. Changes and contact

We may update these terms as Ponko changes. The date at the top shows the last revision, and continuing to use the service after a change means you accept the updated terms. If a change materially reduces your rights, we'll make it visible rather than quiet. Questions about any of this: contact@playponko.com.

12. Governing law and disputes

Ponko is operated from France, and these terms are governed by French law. If you're a consumer living somewhere else, that doesn't take away the protection of the mandatory consumer rules of the country you live in, and you can still bring a case before your local courts.

If something goes wrong, please write to contact@playponko.com first — nearly everything is settled that way. If we can't resolve it between us, consumers are entitled to use a consumer mediator free of charge; contact us at that address and we'll give you the details of the applicable mediation scheme.
